Welcome to TextifyALL. By accessing or using our website (https://TextifyALL.com) and services, you agree to be bound by these Terms of Service. If you do not agree with any of these terms, please do not use our service.

1. Acceptance of Terms

By creating an account or using any part of the TextifyALL service, you confirm that you are at least 13 years of age and have the legal capacity to enter into this agreement.

2. Description of Service

TextifyALL provides AI-powered audio and video transcription, subtitle generation, and translation services. We reserve the right to modify, suspend, or discontinue any part of the service at any time with or without notice.

3. User Accounts

  • Account Creation: You must provide accurate and complete information when registering. You are responsible for maintaining the confidentiality of your credentials.
  • Account Security: You agree to notify us immediately of any unauthorized use of your account.
  • One Account per User: Creating multiple accounts to circumvent usage limits is prohibited.

4. Acceptable Use

You agree NOT to use TextifyALL to:

  • Upload content you do not have the right to process or distribute.
  • Transcribe or translate material that is illegal, harmful, defamatory, or infringes third-party intellectual property rights.
  • Attempt to reverse-engineer, scrape, or abuse our AI infrastructure.
  • Resell or redistribute our service outputs without explicit written permission.
  • Conduct any activity that could damage, disable, or impair our servers or networks.
  • Use automated scripts, bots, or any other unauthorized means to access the service, or otherwise impose an unreasonable or disproportionate load on our infrastructure (including GPU compute resources).

5. Intellectual Property

  • Your Content: You retain full ownership of all audio/video files you upload and all transcripts generated from them.
  • Our Service: The TextifyALL platform, software, brand, and underlying AI infrastructure are proprietary to TextifyALL. You may not copy, modify, or distribute any part of our platform.
  • Feedback: Any feedback or suggestions you provide to us may be used by TextifyALL without obligation to you.

6. Privacy and Data Handling

Your use of the service is also governed by our Privacy Policy. Key points:

  • Uploaded files are permanently deleted within 24 hours of processing.
  • Your content is never used to train AI models.
  • Payment data is handled exclusively by Creem, our Merchant of Record.

7. Payments and Subscriptions

  • Merchant of Record: Our order process is conducted by our online reseller Creem. Creem is the Merchant of Record for all our orders and is responsible for managing the checkout experience, billing, and applicable taxes.
  • Processing: All purchases, subscriptions, and refunds are handled through Creem in accordance with their terms of service and refund policies.
  • Refunds: All purchases are non-refundable unless otherwise specified by Creem's policies or required by applicable law.
  • Subscriptions: Subscription plans auto-renew unless cancelled before the renewal date via your account dashboard or the payment portal provided by Creem.
  • Pricing: We reserve the right to change pricing with advance notice to active subscribers. All prices are displayed in USD.
  • Chargebacks: Payment disputes or chargebacks filed outside of Creem's official resolution process may result in immediate account suspension.

8. Disclaimer of Warranties

The service is provided on an "as is" and "as available" basis without warranties of any kind, express or implied. We do not guarantee that transcription or translation output will be 100% accurate, error-free, or suitable for any particular purpose.

9. Limitation of Liability

To the fullest extent permitted by law, TextifyALL shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the service — even if we have been advised of the possibility of such damages.

10. Indemnification

You agree to indemnify and hold harmless TextifyALL and its affiliates from any claims, damages, or expenses (including legal fees) arising from your violation of these Terms or your misuse of the service.

11. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes shall be resolved through binding arbitration under the rules of the American Arbitration Association (AAA), with proceedings conducted in English in San Francisco County, California.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by updating the Effective Date above. Your continued use of the service after changes are posted constitutes acceptance of the new terms.
